What are Paingone's general terms and conditions?

Your purchase is from Paingone, a trading name of Quality Health Innovations, UK establishment number BR022984, VAT number GB491719363. All orders and customers will be serviced by Tower Health, 24 Manvers Business Park, High Hazles Road, Nottingham, NG12 3GZ.

Unless otherwise specified, the materials on this website are direct solely at customers who access this website from the United Kingdom. Paingone does not represent that any product referred to in the materials on this website is appropriate for use, or available, in other locations. Those whop choose to access the site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. In accordance with UK legislation you must be at least 13 years of age to sign up for an account.

Any contract between us, whether for use of this site or in relation to the purchase of products or services through the site will be governed by the laws of England and Wales and all parties submit to non-exclusive jurisdiction of the English Courts. Any contract will be communicated in English.

We have taken care in the preparation of the content of this website, however we cannot guarantee uninterrupted and totally reliable access to this website, and so therefore cannot guarantee that the information will always be completely up to date and free of mistakes. To the extent permitted by applicable law, Paingone disclaim all warranties; express or implied, as to the accuracy of the information contained in any of the materials on this website and will accept no liability for any loss or damage arising as a result of problems with access.

These terms and conditions shall be governed by and construed in accordance with English law. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Paingone reserves the right to alter these terms and conditions from time to time by posting new terms and conditions on this website.

All brand names, product and service names and titles and copyrights used in this site are trademarks, trade names, service marks or copyrights of their respective holders. No permission is given by Paingone for their use by any person other than the said holders and such use may constitute an infringement of the holders' rights.

All designs, text, graphics and their selection and arrangement on this website are the copyright of Paingone or its content providers. Permission is granted to users to electronically copy or print portions of this site for their own personal, non-commercial use. Any other use of materials on this site without Paingone prior written consent is strictly prohibited.

Acceptance of orders

Working with industry-leading secure payment processors, we validate your order and the payment details you submit to us before your order can be accepted. Once that has been done, we will acknowledge that your order has been received by sending an e-mail to the e-mail address you provide in your registration form.

Your order is then subject to further validation checks we may choose to make. If your order passes our validation checks we will send you an order confirmation email, this is our acceptance of your order and once despatched brings into existence a legally binding agreement between us.

Paingone reserves the right to restrict the number of items available for sale to any individual customer. All orders are subject to availability. If any items are not available and you paid using a debit/credit card or PayPal you will not be charged for the cancelled items.

All orders are subject to validation checks and authorisation by the card issuer. We may submit your order to a third party fraud screening provider who securely review orders on behalf of Paingone to eliminate fraud and safeguard our customers transactions. We may also submit your address, date of birth and the value of your order to Experian Ltd. We will not be liable for any delays to your order this may cause. This information may be retained by Experian Ltd for future validation enquiries by other companies. For more details of the information Experian Ltd hold about you, visit http://www.experian.co.uk/. If the issuer of your payment refuses to authorise payment to us, we will not be liable for any delay or non-delivery. Orders can only be delivered to UK addresses, BFPO addresses and stores.

Mobile Terms of Service

In addition, you agree to our Messaging Terms (https://terms.pscr.pt/legal/shop/ca24e4-3/terms_of_service) and Messaging Privacy Policy (https://terms.pscr.pt/legal/shop/ca24e4-3/privacy_policy).

The Paingone mobile message service (the "Service") is operated by Paingone (“Paingone”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Paingone SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Paingone through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialling system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Paingone. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Paingone or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Paingone mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

 Bulk buying

The Paingone website is available for non-commercial and domestic use only. We reserve the right to reject or cancel your order if we believe you are ordering our products for business or other re-sale purposes. We apply limits to some of our products to protect stock availability so that as many of our customers as possible are able to buy our products. 

Colour reproduction

Paingone has made every effort to reproduce colours on the site as accurately as possible. However, different computers and mobile devices reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the Internet.

If you are not satisfied with the colour of the item you have ordered, we operate a returns policy (see Returns for more information).

Price information

Paingone has taken great care to ensure prices are accurate. All prices include VAT where appropriate. 

Paingone reserve the right to exchange any free product included within an order without prior notice.

Returns

All returns must be accompanied by a returns number (RMA). Refunds cannot be processed without a valid RMA number, and we reserve the right to return such items charging the standard delivery charge.

Goods must be returned in their original packaging, together with this invoice/receipt. Only unopened items that are in a saleable condition will be accepted. Products must be returned with ALL the accessories. If any of the accessories are missing, we reserve the right to charge up to £25 to cover the cost of the missing items.

Return your items using a recorded-delivery service to the address below. Goods should be in their original packaging and with this completed form as proof of purchase. Keep the shipping receipt so that in the event that it is lost, it can be tracked. If we do not receive the product back, you will be liable for the purchase price, as we cannot issue a refund. Please note that you will be responsible for the cost of returning the goods to us unless we delivered the item to you in error or the item is faulty.

Allow up to 10 working days from when we receive your item back to receive your refund. Refunds are processed back to the original payment method.
